My dog was accused of killing sheep but did not do it. What should i do?

For a dog to kill 48 sheep in an hour it would probably have to be armed with a machine gun.

if the witness who *saw* your dog kill the sheep has evidence(which i highly doubt) then u stil have nothing 2 worry about as quite a lot of collies look the same and so the witness stil cant prove it, plus i dont think a dog could kill 48 sheep in an hour, i think you should try and take them to court for accusing you and your dog for doing ABSOLUTELY NOTHING MUHAHAHAHA

How can your dog kill 48 sheep? Was your dog with you all the time if so she could not have killed the sheep.
It was probably a wolf or something like that. Did the farmer see it happening? If not then how is he sure hes right?

If ur collie did not do it then the one that did is still out there.
It will strike again & ur dog should be in the clear.

Have a look for other dogs wandering around & get some video evidence of them.Did a witness see it was a collie that chased the sheep.Is there a farm near by that has a young collie that could have done it.Trained ones do not run wild like that.Do some research to prove ur dogs innocence.

First of all I want to confirm what Basset said. A dog does not have to touch a sheep to kill it. Just being in the same field as a herd of sheep is enough for dozens of them to drop down dead. There r highly stressed animals. If a farmer sees a loose dog in with his livestock he is legally allowed to shoot it there on the spot.

As to ur predicament though once the dog has returned to the house the farmer needs to provide proof that it was ur dog that did it. Camera evidence, blood on the dog if it did bite, etc. For the police or whoever it was that took ur dog to the pound they would have either had to have seen evidence or have a warrant. The dog is ur property & cannot be removed without one. A lawyer is definately the next step. Can u definately account for the dog for the full 24hours. Is he kept in a yard - how do u know he did not get out then return later. Were u & ur dog miles away. Were u seen walking ur dog somewhere public?

Ok, gonna assume that this is in the UK, if not then I am not sure how much this will help.

Firstly it should be up the farmer to prove beyond doubt that it was ur dog that did the attack.

Secondly, without physical evidence the dog should not have been removed from ur property.

Thirdly, DNA tests & teeth impressions will solve this easily, push for those to happen.

Lastly, chances of a collie being able to kill that many sheep in an hour is nigh on impossible. They r the least likely breed of dog to do this. I'd say there is more chance of a rottweiler or german shepard doing this because of their size making it easier to bring down a sheep.

Having seen the remains of $100,000 worth of lambs that were killed in one night by one dog, I sure hope u do not live in Utah or Wyoming because unless u have proof that u know where ur dog was (other than just saying) u will be held liable.

Now bear in mind that this is from a dog lover. But, during calving season if I spot a stray dog in one of my fields, it will not be going home. It is just that simple, & has to be that simple. A dog can bankrupt a rancher, it is that serious a deal. It is also lawful in all of the western states that I am aware of for a rancher to shoot a stray dog that is harassing stock.

You need to first prove that ur new dog is not agressive to animals, & would not kill..

I think that this is going to be hard to prove, but it might be plossiable.. I saw a show on Judge Judy that was similar to this & the dog owner won.

If this was me, I do have an agressive shnauzer to cats.. I would have to say maybe he did it, just for Buddy wants to kill my own cat!

These r the questions that would prove or dis-prove the dog was envoled in the death of 48 sheep! I think that a rottwiller or pittbull did this & not a colie, for colie is r ment to herd sheep not kill them!! 48 seems aweful high!!

It is not hard to prove your dog did not do it (If you're certain he did not do it). After that you can counter sue them for emotional and physical damage to your persona (Just kidding, but you could).

If your dog killed even one sheep, wool would be between her teeth and she would have been bloody.

if u can account for the dog the whole day then should have no problem. plus if the dog has never had a problematic past they have nothing to go on. it is very unlikely for one dog to kill a sheep every 1.25 minutes. not even a whole pack of wolves or something could do that. i dont believe they have a case. u could possibly have one though because of them impounding ur dog & the fact it will cost u to get the dog back & if u have attorney fees for if they take u to court. If you can account for your dog for the entire day then you should be OK. If you find out the dog that did do the damage take it back to kill some more of the smelly, woolly ,rotten footed horrible tasting beasts.,

hats absolutly rediculous, they have no proof whatsoever & have no right to take the dog from u if no one saw him or anything. Get DNA from ur dog & compare it to the DNA on the sheep. You r no fool & let them see that.


And 48 adult sheep in one hour? By a Collie? Are u kidding me? Thats a job for a pack of Labradors or Rotties or some strong dogs, & it would have taken longer than that.
Your dog would be a bloody exhausted mess if he was even partly responsible for this crime.

Counter sue, do not let them get away with that & do everything in ur power to get ur dog out of the pound.

With that many sheep killed there will be plenty of canine DNA in the bite wounds. Tell the police you demand they take DNA evidence from the sheep is wounds and have it analysed. If they refuse you can hire a lawyer and win in court. All they have is circumstantial evidence. By no means let them euthanize your dog. If they do sue them and make sure you get a DNA sample from your dog is body.

was the farmer smokin crack? Tell the farmer if he can explain to you how your dog would kill 48 sheep in one hour you might think about not laughing in his face.

How could they take away ur dog without sufficient evidence. Unless they can prove that ur dog was on their property (live video) is not is all circumstantial evidence?

I do not know the law well & I assume u do not either. I'd highly recommend discussing ur rights (and ur dogs) with a local lawyer that u may know & see if he had suggestions. I'd fight them & try to get ur dog back ASAP. If u had people over that day have them vouch for u if they happen to see the dog. A shelter is not a healthy place for any animal.

What is their prrof that it was your dog? Collies are hearding dogs, not killers. Also, 48 dead sheep killed by 1 dog is a bit ridiculous.
You have rights and just because they think it was your dog does not seem to be enough to ''lock him up''. I would definitely fight this. Tell Animal Control that you can account for the dog all day. Mistakes happen.try to prove that one was made. Good Luck!

This is not really a ''dog'' section question. You need to contact an attorney as this is a serious legal issue and your dog will be killed if you do not take serious action.

I would think that the first step would be to perform necropsies on the sheep and find out if it was a dog and what size the dog was. Remember, the burden of proof is on the plantiff/state.

Is your dog allowed to roam? If so, then you set yourself up for this kind of accusation.

There is an organization which I think is called Justice for Dogs (try putting it in a search engine). I was told about it last year and it was set up by a solicitor who loves dogs just to help with dog law problems.

If they do not have evidence it was ur dog then they r commiting a crime by having ur dog in the pound because ur dog is innocent until proven guilty!!!

Besides how would one single dog kill 48 sheep, they would be out there for HOURS!!!

Maybe it was coyotes or wolves or stray dogs.

Add on: as others have said do the dna samples from the bites of the sheep & from ur dog, also they would have to have videos, photos, or hair from u dog from the farmers land to prove it was ur dog..

I'd be demanding that they get positive DNA proof that it was my dog. I'd also be pushing for them to look at dental impressions which could exclude your dog more quickly.

Killing 48 sheep in an hour sounds more like a pack than a single dog. Either way, the dog(s) in question would have been bloodied.

What makes them think it was your dog? Has your dog been running loose? How do you know it was not your dog? Just a strange dog running amoung pregnant sheep can stress them enough to kill them or make them miscarry.

EDIT: PEOPLE! The dog does not have to be mean, he does not have to have touched the sheep. Just by being there or chasing them he could stress them enough to kill them.

Are u in the states or a different nation? If the dog was not loose, I would not have let them take it without a warrant. In the US people just can not ''take'' if u refuse unless they can get their hands on them (running loose). They have to have a warrant.

As far as the ''sued'' part, it happens easily. In the US anyone can sue anyone for anything. That does not mean they will win. And even if they do win, it does not mean they will actually ever get any compensation from the judgement. Take this one step at a time & consult an attorney if u need to.

Call animal control and find out what your rights are. If the farmer has no proof and you can account for your dog, it seems like you should have some recourse. I doubt seriously that any dog could kill 48 sheep in one hour. As for the lawsuit, you will need an attorney.

thats ridiculous!! not even a pack of wolves could kill 48 sheep in an hour. Why do they think its your dog? you should get a lawyer, especially if the dog was with you all day.please provide more details about y they think its your dog

I would think this would be harder than all hell for this farmer to prove. And I honestly find it hard to believe a collie would kill 1 sheep, let alone 48. They're just bred to herd them, not hunt them. I can not imagine this guy has any real proof so I do not know how he was able to get anyone to take your dog away!
